Christmas shutdowns can affect key dates in Queensland property contracts. Many banks, conveyancers and government departments close or reduce their hours over this period. Under the standard REIQ contract, 27–31 December are non-business days. This means any finance, building and pest, or settlement date falling between 25 December and 1 January will automatically move to 2 January 2026. However, not all contracts include this clause, so in non-standard contracts your deadlines may still fall due during the shutdown. If you’re signing a contract in December, it's important that you check that your finance and settlement timeframes allow enough room for bank approvals and valuations - delays are common at this time of year, and you don’t want to risk being in breach. #MacDonaldLaw

Duty lawyers are available at Court when you are appearing for a first return or a mention and can assist you with legal advice or appearing on your behalf at no cost. A duty lawyer can help with things like entering a guilty plea, adjournments, bail applications and variations, and sometimes holding a case conference with the prosecutor. However their role is limited - they are only available on the day, have very little time to understand your matter, and they cannot act in trials, committals or more complex sentences. By contrast, engaging your own lawyer means: ▪️ You have the chance to meet and prepare before your court date. ▪️ Your lawyer can review the brief, gather supporting evidence, and negotiate early with prosecutors. Duty lawyers play a valuable role, but their support is limited. If your matter is serious or complex, having your own lawyer ensures you are properly prepared and your case is put forward in the strongest way possible. #MacDonaldLaw

Thinking about separating, but not in a position to move out just yet? You’re not alone, this is known as separating under one roof. It’s more common than you might think. That said, there are a few things to keep in mind: What to avoid: ❌ Arguing in front of the children - shielding them from conflict is essential. ❌ Speaking disrespectfully to one another. ❌ Allowing tension to escalate into domestic violence, even unintentionally, due to the stress of sharing a space post-separation. What to do instead: ✔️ Keep communication respectful, even when it’s difficult. ✔️ Put a plan in place to live separately, staying under one roof long-term often creates more confusion and emotional strain. ✔️ Set clear boundaries for the shared space so expectations are understood on both sides. If domestic violence occurs while you’re still living together, the affected party may apply for a domestic violence order, which can include an order to remove the other person from the home. ✈️ Overseas travel with a criminal record: what you should know. A criminal conviction in Queensland does not automatically prevent international travel, but it can create significant barriers. Many countries including the USA, Canada and Japan have strict entry rules if you’ve been convicted of certain offences like drug, violence, domestic violence, or fraud matters. Even where a conviction is considered “spent” (meaning it no longer needs to be disclosed for most jobs and checks after a set period of time) under Queensland law, overseas immigration authorities may still take it into account. In some situations, such as where someone is classed as a reportable offender, written approval from Queensland Police is required before leaving Australia. If you are concerned about how your record may affect future travel, seeking legal advice before making arrangements is the most reliable way to avoid complications at the border. #MacDonaldLaw

As of July 2025, police in Queensland can now use handheld metal detectors to “wand” individuals in any public place, including parks, footpaths, shopping centres, and public transport, without a warrant and without needing reasonable suspicion. This is part of what’s known as Jack’s Law, which was originally introduced as a trial in nightlife precincts and transport hubs. That trial has now ended, and it has been made permanent across the state. 🔹 Can I be stopped without doing anything wrong? Yes. Police do not need a reason to stop and wand you. If you’re in a designated wanding area, they can conduct a search regardless of your behaviour or appearance. 🔹 Can I refuse to be scanned? No. If you’re in a wanding area and police ask to scan you, you must comply. Refusing may result in charges such as obstructing police. However, officers are required to follow specific procedures, including identifying themselves and explaining what they’re doing. 🔹 What if I have questions or concerns? We recommend you ask Police to allow you to speak with a lawyer to obtain immediate legal advice. If you are charged with an offence following a wanding search, it is important you speak with a lawyer as early as possible. #MacDonaldLaw

Buying or selling a property in Queensland? New seller disclosure rules are now in effect. From 1 August 2025, sellers in Queensland are required to provide buyers with a disclosure statement (Form 2) and relevant certificates before the contract is signed. This includes key details such as: ▪️ Title search ▪️ Zoning and planning information ▪️ Registered easements ▪️ Pool safety certificates ▪️ Body corporate records (if applicable) ▪️ Registered or unregistered leases or agreements The goal of these new rules is to ensure buyers are better informed upfront, to reduce the risk of disputes or surprises later on. However, not everything is captured in the standard disclosure form. Information such as past flood events, unapproved structures, or termite damage is not required to be disclosed under the new rules. For that reason, conducting your own due diligence remains essential. If you're in the process of buying, make sure you’ve been provided with the correct disclosure documents before signing. And if you’re unsure what to look for, we do recommend getting in touch with our conveyancing team. #MacDonaldLaw

Who counts as a parent under Australian family law?⁠ ⁠ A recent Full Court decision has confirmed that a biological connection is not always required for a person to be legally recognised as a parent.⁠ ⁠ In Ophoven & Berzina [2025], the Court declared that a man listed on a birth certificate was a parent, despite not being genetically related to the child. The key factors?⁠ ⁠ ✔️ His intention to parent⁠ ✔️ His role in the child’s life⁠ ✔️ His registration on the birth certificate⁠ ⁠ The Court found that under section 69VA of the Family Law Act, a lack of biological connection does not automatically disqualify someone from being declared a legal parent.⁠ ⁠ #MacDonaldLaw

The Queensland Government has introduced new laws under the Making Queensland Safer reforms.
